1. Definitions

  • “Provider” – BoxSRV.net, operated by Tiziano Santo Metzler, Bautzener-Allee 59, 02977 Hoyerswerda, Germany, +4915901084284 [email protected].
  • “Customer” / “you” – Any natural or legal person registering for, or using, our Services.
  • “Services” – All free and paid hosting solutions (Minecraft servers, web‑hosting, related add‑ons) described in Section 3.
  • “Contract” – The legally binding agreement concluded when you click “Order”, “Register” or otherwise accept these Terms.

2. Scope

These Terms govern every use of the Services. Conflicting general terms from the Customer are rejected. Mandatory statutory rights—especially under EU consumer law—remain unaffected.

3. Description of Services

  • Free Minecraft Hosting – 3 GB RAM, 10 GB SSD, plugin support, DDoS shield, Pterodactyl panel & free sub‑domain.
  • Paid Minecraft Hosting – Custom specs, priority CPU, optional daily backups, 99 % uptime & priority support.
  • Paid Web‑hosting – KeyHelp panel, PHP, MySQL, FTP/SFTP, webmail, domain support, 99 % uptime.
  • Plan Lengths – 1 / 3 / 6 / 12 months with 0 / 5 / 10 / 15 % discount respectively.

4. Registration & Account Security

Provide accurate information and keep login credentials confidential. You must promptly report any unauthorised access.

5. Fair‑Use, Reselling & Prohibited Content

  • Fair‑Use – “Unlimited” resources may be used as needed for normal operation. Excessive use may be throttled after notice.
  • Reselling – Customers may resell or sub‑lease their allocated resources; you remain liable for downstream users.
  • Prohibited – Cracked servers, crypto‑mining, pornography, unlicensed streaming, botnets, malware, DDoS tools or any illegal activity.
  • Monitoring – Minimal technical logs for DDoS mitigation are retained for ≤ 7 days.

6. Maintenance & Service Levels

Planned maintenance is announced ≥ 24 h in advance by email and status page. Unplanned emergency maintenance is executed as swiftly as reasonable.

Failure to reach 99 % monthly uptime on paid plans entitles you to a service credit of one day’s fee per full percentage point below 99  %, capped at 100  % of the monthly charge.

7. Pricing, Payment, Renewals & Refunds

  • Payments via Stripe; prices include VAT unless otherwise stated.
  • Pre‑paid: Fees are debited from your account balance on renewal if sufficient funds exist; otherwise the service lapses.
  • Reminder emails are sent 7 days before expiry.
  • Unused full months are refunded pro‑rata to your account balance.

8. Data Protection (GDPR)

  • See our separate Privacy‑Policy for full details.
  • We store account, billing and technical log data only as needed for service provision.
  • Backups are retained for up to 3 days (latest three copies).
  • Data is processed in Germany; only traffic via Cloudflare may leave the EU under SCC 2021/914.

9. Backups & Data Integrity

We perform daily host‑level snapshots, but the Customer remains solely responsible for creating and verifying their own backups through the control panel.

10. Inactivity & Automatic Termination (Free Plans)

Free Minecraft servers with no active players for 60 minutes are suspended; data is retained.

If no login occurs for 3 months, we notify you by email; without action, the account is purged after 14 days.

11. Right of Withdrawal (EU Consumers)

Private customers may withdraw from paid contracts within 14 days of first purchase without giving reasons (Directive 2011/83/EU).

If services have already begun during the withdrawal period, you owe a proportionate amount corresponding to the services already provided.

12. Termination by Either Party

You may cancel via the dashboard at any time; termination is effective at the end of the current billing cycle unless you request earlier deletion. We may terminate for cause—particularly violations of Sections 5 or 8—with immediate effect.

13. Limitation of Liability

We are liable without limitation for intent and gross negligence and for injury to life, body or health. For slight negligence we are liable only for breach of essential contractual duties and then limited to typical, foreseeable damages. Liability under the German Product Liability Act remains unaffected.

14. Modifications to These Terms

We may amend these Terms for valid reasons (e.g. legal changes, security, new features). Customers will be informed by email at least 30 days before changes take effect. If you object, you may terminate the contract before the effective date.

15. Governing Law & Jurisdiction

German law applies, excluding UN sales law.

If you are a merchant (Kaufmann), exclusive jurisdiction is Hoyerswerda, Germany.

The EU Commission’s Online‑Dispute‑Resolution (ODR) platform is available at https://ec.europa.eu/consumers/odr. We are not obliged and do not participate in alternative dispute resolution before a consumer arbitration board.

16. Severability & Final Provisions

If any clause is or becomes invalid, the remainder remains effective. The invalid clause will be replaced by a valid one that comes closest to the economic purpose. No verbal side agreements exist.
